By accessing or using onsoul.ai ("Platform", "Service", "we", "us"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Platform.
onsoul.ai is operated by OUTSI SP. Z O.O. (OUTSI SPOLKA Z OGRANICZONA ODPOWIEDZIALNOSCIA), a company registered in Poland. Registered office: Kartuska 2, 83-334 Miechucino, Poland. KRS: 0000935494, NIP: 5892069190.
We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify registered users of material changes via email or in-app notification at least 30 days in advance.
You must be at least 18 years old to use onsoul.ai. By creating an account, you confirm that you are 18 or older. We require date of birth during registration to enforce this requirement.
We reserve the right to request additional age verification at any time and to terminate accounts that violate this requirement. Users who participate in the Creator Program and request a payout are additionally required to complete manual identity verification (KYC) before any payout is released. See Section 4.2 of the Creator Agreement for details.
All characters on onsoul.ai are powered by artificial intelligence. You are interacting with AI, not a real person. AI-generated responses are unpredictable and may be inaccurate, biased, or offensive. You should not rely on the accuracy or completeness of AI-generated content.
AI-generated images on the Platform are synthetic and do not depict real individuals.
You are responsible for maintaining the security of your account credentials. You are solely responsible for all activity under your account. Notify us immediately at support@onsoul.ai if you suspect unauthorized access.
The following content and conduct are strictly prohibited on onsoul.ai. Violations may result in immediate account termination and reporting to law enforcement.
When uploading images or other media to onsoul.ai, you represent and warrant that:
We employ automated content moderation systems to detect and block prohibited content, including real-person face detection and CSAM scanning. Content flagged by our systems may be blocked automatically or queued for review.
We reserve the right to remove any content at our sole discretion without prior notice.
onsoul.ai permits adult content (NSFW) for users who are 18 years of age or older and have confirmed their age. NSFW content is gated behind age verification and is clearly labeled.
Even within NSFW content, all prohibitions in Section 5 apply without exception. Adult content involving minors, non-consensual scenarios depicting real persons, or illegal acts is strictly forbidden.
Creators who publish characters on onsoul.ai and participate in the monetization program are subject to the Creator Agreement, which governs earnings, payouts, content responsibilities, and termination policies.
By activating creator monetization, you agree to both these Terms of Use and the Creator Agreement. In case of conflict, the Creator Agreement takes precedence for creator-specific matters.
Your content: You retain ownership of content you create or upload to the Platform. By submitting content, you grant onsoul.ai a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, distribute, and display that content in connection with operating and promoting the Platform.
AI-generated content: Content generated by our AI systems in response to your input is provided as-is. You may use AI-generated content subject to these Terms, but we make no warranties regarding ownership, originality, or non-infringement of AI-generated output.
Platform IP: All Platform branding, design, code, and technology remain the exclusive property of onsoul.ai.
We respect intellectual property rights. If you believe content on onsoul.ai infringes your copyright, submit a DMCA takedown notice to:

Non-consensual intimate imagery: In compliance with the TAKE IT DOWN Act, reports of non-consensual intimate images (including AI-generated) will be actioned within 48 hours. Submit reports to safety@onsoul.ai.
Repeat infringers will have their accounts terminated.
Subscriptions auto-renew at the end of each billing period. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period.
Refunds: Payments are non-refundable except where required by applicable law (including EU 14-day withdrawal rights for digital content not yet consumed) or in cases of billing errors.
We will provide at least 30 days' notice before any price increases. Credits are non-transferable and have no cash value.
Payments are processed by our payment provider. Your payment information is handled directly by our payment processor and is never stored on our servers.
onsoul.ai is an entertainment platform. AI characters are not therapists, counselors, or medical professionals. Do not rely on AI characters for mental health support, medical advice, or crisis intervention.
If you or someone you know is in crisis:
We implement automated detection for self-harm and suicidal ideation in conversations and will display crisis resources when detected.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.
We are not responsible for the accuracy, quality, or legality of user-generated content, including characters created by other users.
To the maximum extent permitted by law, onsoul.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
Our total liability shall not exceed the greater of $100 or the amounts you have paid to onsoul.ai in the 12 months preceding the claim.
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration, except where prohibited by law. You agree to waive the right to participate in class action lawsuits or class-wide arbitration.
You may opt out of this arbitration agreement within 30 days of creating your account by sending written notice to legal@onsoul.ai.
We may suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (IP, liability, disputes) will survive.
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
